Alleviating Obstacles to Sponsorship

Officially, a family can sponsor the person who helps raise their children for a green card, which allows that person to live and work in the United States. But the aging American immigration system has gotten in the way, resulting in a broken process in which domestic caregivers who do seek citizenship almost always get rejected.
New York City immigration attorney Charles Goldsmith says that if someone approaches his office seeking to sponsor the person watching their child, nine times out of 10 he doesn’t take the case because “it’ll go nowhere.”
As a result, the vast majority of these workers are employed illegally, making them vulnerable to low pay, workplace abuse and an inability to seek out care if hurt on the job. Families that hire undocumented immigrants are also committing tax fraud if they pay under the table.
“It’s a burden for parents,” says Marcia Hall, president of the International Nannies Association. “There are so many families that don’t understand [the laws] and how they can get in trouble if they don’t abide by them.”
Conservative lawmakers believe the answer to this situation is to focus solely on American workers. But many immigration experts say the system must be modernized for today’s workforce.

Make it more affordable

In general, people who want to sponsor a domestic worker shell out $5,000 to $10,000 — a hefty burden to many.
There are costly legal and governmental fees, plus the law requires parents to advertise in a newspaper (which can cost hundreds of dollars) to prove their child’s caregiver has distinct abilities that no other American worker has. “Advertising in print newspapers is utterly obsolete and passe,” says James Pittman, a Philadelphia-based immigration lawyer.
And what if a family and their childcare provider wanted to share the fees? Immigrants can reduce the costs by applying for a financial hardship waiver, but there’s little to help available for working parents.

Expedite the application process

Normally, it takes about eight months for the U.S. Department of Labor to process the first round (of at least three) of a childcare provider’s paperwork. During that time period, the babysitter’s 6-month tourist visa (if she had one) will expire forcing her to return home. “Many families find that domestic worker who takes care of their children and wants them to become part of the family, only to find out there really is no way to do it,” says Jackie Vimo, an economic justice policy analyst with the National Immigration Law Center.

Modify the existing H-2B program

Each year, 66,000 H-2B visas are available to non-agricultural workers without a secondary or professional degree. They usually go to seasonal employees at resorts and sometimes to landscapers or fishermen.  People can stay on the visa for 12 months and are eligible for two one-year extensions, but experts say that more should be made available — primarily because of the need for immigrants within our economy. “They’re the ones who are helping take care of our children and allowing for American women to work,” says Goldsmith.

Consider paying taxes

Many undocumented caregivers came to the United States decades ago. Some overstayed their visas, others never had them — but they were almost always in search of a better and safer life. Under current law, undocumented immigrants who have paid taxes and have proven good moral character for 10 years, plus have a legal parent, spouse or child who would “suffer extreme or unusual hardship” as a result of her deportation, can petition for legal status under section 240A(b) of the Immigration and Nationality Act. Admittedly, no one would endorse or wish hardship on a loved one for the sake of legal residence. But paying taxes and contributing to the American Social Security system might give more political support in Washington, D.C. for a pathway to legal status for undocumented workers.

How Jobs Give Low-Income Mothers More Than a Financial Boost

Are young children better off when their mothers stay home or when they go to daycare? It’s a question that has been hotly debated for decades and will likely never be settled, but a new study by Boston College researchers suggests that low-income kids with working mothers perform better in kindergarten than their counterparts whose mothers stay home.
The study, published in the journal Developmental Psychology, followed 10,700 children born in 2001, and found that when low-income mothers returned to the workforce before their babies were nine months old, their children performed better in standardized tests of reading, math and vocabulary in kindergarten. When low-income mothers returned to work when their kids were between 9 months and two years old, their children had fewer behavioral problems in kindergarten, according to teacher surveys.
Meanwhile, children of middle-income women showed no significant difference in behavior or cognitive abilities whether their mothers stayed home or not, and the kids of high-income mothers showed a slight decrease in ability when their mothers worked. Prior studies of kids born in the 80s and 90s had suggested some negative effects of childcare across all income levels.
Caitlin McPherran Lombardi, lead author of the study, told the American Psychological Association: “Different cultural attitudes, more readily available and higher-quality child care and more fathers participating in childrearing are other possible reasons for the difference.”
She also noted that continued employment seems to make a big difference in the low-income mothers’ lives too—58 percent of mothers in the study returned to work by the time their child was 9 months old.
“Most mothers today return to full-time work soon after childbirth, and they are also likely to remain in the labor market five years later, suggesting the employment decisions soon after childbirth are pivotal to determining mothers’ long-term employment,” she said. “Our findings suggest that children from families with limited economic resources may benefit from paid maternal leave policies that have been found to encourage mothers’ employment after childbearing.”

A Safe Childcare Option for Low-Income Parents Working the Night Shift

It’s hard enough to find high-quality, affordable childcare. But when you work the night shift, as many low-income mothers and fathers do, it can be an insurmountable challenge.
Fortunately, for parents living in Chillicothe, Ohio, there’s an answer: An overnight childcare center.
The Carver Community Center is partnering with Goodwill Industries to expand its daycare services to offer childcare around the clock. Justine Smith, the director of the center, told Dominic Binkley of The Colombus Dispatch, “There are a lot of second- and third-shift jobs available in Columbus. (Parents) are more than happy to drive to Columbus for work, but when it comes to child care, they’re kind of stuck.”
As middle-class parents can attest, the cost of childcare isn’t cheap. (A recent report showed that childcare has become more expensive than college tuition in 31 states.) However, the Carver Community Center manages to keep prices low — most parents pay only $55 to $130 a week — through donations, grants, and support from the Ohio Department of Job and Family Services. Some families that are especially needy only contribute a co-pay of a few dollars.
Still, even if the childcare is affordable, it has to be offered during the hours that parents can actually use it. The Carver Community Center’s rare nighttime hours will allow many parents keep their jobs and not depend on inconsistent or unsafe overnight care for their kids.
Currently there’s a waiting list for night care at the center. “I can honestly say I hate to turn a child away,” Smith told Binkley. “If somebody gave me $1 million, then I would have every kid in the world in this place, but I’ve got to look at the funding.”
For the families that the center is able to help, however, the security that comes with knowing their children are well cared for while they work is priceless.

What happens if you give a single mom high-quality childcare, higher education and a place to live? A whole lot, actually.
The Jeremiah Program in Minneapolis has helped more than a thousand low-income single mothers and their children build better lives and break the cycle of poverty since it began in 1998. The program provides the mothers with affordable housing at its campus and free preschool for the children so their moms can pursue their education at nearby Minneapolis Community & Technical College. Ninety-five percent of the kids leave the preschool ready for kindergarten, and ninety-percent of the mothers are able to maintain steady employment after they finish the Jeremiah Program. This program works so well because it addresses the problems faced by two generations at once—low-income moms often struggle to complete their educations or hold a job while dealing with the demands of caring for young children, while their kids often receive sub-standard childcare or don’t attend preschool at all, setting back their educations before they even begin.
It costs about $25,000 to see one mom and her children through the program, but an independent analysis found a $4 return to the community for every dollar invested in these families, and a $16 million lifetime benefit for every 100 families elevated from poverty. The Jeremiah Program has expanded to Austin, Texas, Fargo, N.D., and St. Paul, Minn., while cities including Boston, Rochester, Minn. and Dayton, Ohio are working to replicate the program. Amira Masri, who participates in the Jeremiah Program with her daughter Arcadia, told Mary Stegmeir of the Des Moines Register, “My mom was a single mom, and her mom was a single mom. I feel like I’m the (one) that’s going to change our pattern … and end the cycle of poverty here, now with Arcadia.”
